Summary

Certified instructors may teach in a home pool. HOAs can’t stop it.

The bill stops homeowners' associations from banning or restricting swim lessons taught in a home pool by an owner, resident, or guest who is a certified swim instructor. It touches HOAs, homeowners and renters with pools, and instructors trained to American Red Cross, YMCA, or equal standards. On the ground, HOA rules that block these lessons become void, though an HOA can still require lessons to be in the back yard, out of street view, between 8 a.m. and 8 p.m., capped at four students, and with access to a real restroom.

(b) Except as provided by this section, a property owners'

association may not adopt or enforce a provision in a dedicatory

instrument that restricts or prohibits a property owner or resident

who is a certified swim instructor, or an owner's or resident's

guest who is a certified swim instructor, from providing swim

instruction using a swimming pool located on the owner's or

(ii) a garage attached to the property's

principal dwelling; or

(iii) an accessory building on the

property.

(d) A provision that violates Subsection (b) is void.

SECTION 2. This Act takes effect September 1, 2025.
