The bill changes the close-in-age defense in the state's indecency with a child offense by striking the words that limited the defense to an actor of the opposite sex. It touches young people charged under that section who are no more than three years older than the other person, used no force or threat, and are not already on the sex offender registry for this offense. Starting September 1, 2025, the same age-gap defense covers same-sex cases as well as opposite-sex cases, including cases still pending on that date, while final convictions already on the books stay as they are.
