Summary

Within 50 miles of high growth, which the bill never defines.

The bill tells the Texas Water Development Board to move certain cities to the front of the line when it hands out help from its state revolving funds. The cities that benefit are those located within 50 miles of an "area of high growth," but the bill does not define that phrase. Starting with applications filed on or after September 1, 2025, those cities get priority, as far as federal law allows.

A BILL TO BE ENTITLED

AN ACT

relating to prioritization of requests for financial assistance

from certain funds administered by the Texas Water Development

Board.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter J, Chapter 15, Water Code, is amended

by adding Section 15.6043 to read as follows:

Sec. 15.6043. PRIORITY FOR CERTAIN MUNICIPALITIES. In

providing financial assistance from any revolving fund established

under federal law, give priority to a request for financial

assistance from a municipality located not more than 50 miles from

an area of high growth.

SECTION 2. The change in law made by this Act applies only

to an application for financial assistance submitted to the Texas

Water Development Board on or after the effective date of this Act.

An application submitted before the effective date of this Act is

governed by the law in effect immediately before the effective date

of this Act, and the former law is continued in effect for that

purpose.

SECTION 3. This Act takes effect September 1, 2025.
