Summary

Leftover program money goes home by January 1, 2026.

The bill orders the state environmental commission to send back to counties, by January 1, 2026, the leftover money collected before September 1, 2025 for the low-income vehicle repair, retrofit and early-retirement program. It touches counties that are or were in the program and sent those vehicle fees to the state, with money split roughly by how much each county or region paid in. Counties that get the money may spend it only on programs already allowed under the existing clean-air section, and the payout depends on the Legislature actually appropriating the funds.

Estimated Two-year Net Impact to General Revenue Related Funds for HB1361, As Introduced: an impact of $0 through the biennium ending August 31, 2027. However, there would be a fiscal impact of ($176,300,000) to the Clean Air Account No. 151 in the 2026-27 biennium. The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter G, Chapter 382, Health and Safety

Code, is amended by adding Section 382.221 to read as follows:

Sec. 382.221. DISTRIBUTION OF LOW-INCOME VEHICLE REPAIR
