Summary

550 feet from crushers, asphalt plants and each other.

The bill orders the state environmental commission to write rules keeping concrete batch plants that run under the state's standard permit at least 550 feet from a concrete crushing facility, a hot mix asphalt plant, or another such batch plant. New plants authorized on or after September 1, 2025 cannot operate inside that distance, and older plants must stop running at the same time as a nearby facility of those types once their permit authorization is renewed. Batch plant operators and the neighbors who live near clusters of these plants are affected, and the rules start with a September 1, 2025 effective date.

A BILL TO BE ENTITLED

AN ACT

relating to the location and operation of certain concrete batch

plants.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter C, Chapter 382, Health and Safety

Code, is amended by adding Section 382.0651 to read as follows:

Sec. 382.0651. LOCATION AND OPERATION OF CERTAIN CONCRETE

BATCH PLANTS. (a) In this section, "concrete batch plant" means a

concrete plant that performs wet batching, dry batching, or central

mixing.

(b) The commission by rule shall prohibit the operation of a

concrete batch plant operating under a standard permit issued under

Section 382.05195 within 550 feet of a concrete crushing facility,

a hot mix asphalt plant, or a second concrete batch plant operating

under that standard permit, unless the first concrete batch plant

was authorized to begin operations before September 1, 2025.

(c) This subsection applies only to the renewal of an

authorization to use a standard permit issued under Section

382.05195 for a concrete batch plant that was authorized to begin

operations before September 1, 2025. After the renewal of the

authorization, the commission shall prohibit the operation of the

concrete batch plant at the same time as any of the following types

of facilities located within 550 feet of the concrete batch plant:

(1) a concrete crushing facility;

(2) a hot mix asphalt plant; or

(3) another concrete batch plant operating under a

standard permit issued under Section 382.05195.

(d) The measurement of distance for the purposes of this

section must be taken from the point on the concrete batch plant

that is nearest to the concrete crushing facility, hot mix asphalt

plant, or other concrete batch plant toward the point on the

concrete crushing facility, hot mix asphalt plant, or other

concrete batch plant that is nearest the concrete batch plant.

SECTION 2. This Act takes effect September 1, 2025.
