Summary

Prove its policy violates the state ban. Immunity is waived, and the winner can get attorney’s fees.

The bill lets a person hurt by someone unlawfully present in the United States, or the family representative of a person killed, sue a city, county or other local entity or a campus police department for damages. To win, the person must prove the local entity or department had a policy that violates the state's existing ban on limiting immigration enforcement, and that its failure to follow that law gave the unlawfully present person access to the victim. The state waives governmental immunity for these suits, the court may award attorney's fees to whichever side wins, and the bill applies to claims arising on or after September 1, 2025.
