Summary

Those claims leave proportionate responsibility. No splitting damages by fault share.

The bill takes claims against people who control a securities seller, or who materially help one, under the Texas Securities Act out of the state's proportionate responsibility law. Proportionate responsibility normally splits damages among defendants by their share of fault, so this touches executives, controlling owners and helpers sued by investors under Section 4008.055 of the Government Code. Investors bringing those claims would no longer have a defendant's payment cut by fault percentages under Chapter 33, starting September 1, 2025.
