Summary

A student gets a seat. Not a vote.

The bill lets a local school board appoint a student to sit on the board as a nonvoting student trustee. It applies to school districts not already covered by an existing student-trustee section of the Education Code, and it touches school boards and the students they choose to appoint. A board that opts in can seat a student who attends and takes part in open meetings, but the student cannot vote, make or second motions, or count toward a quorum.

A BILL TO BE ENTITLED

AN ACT

relating to allowing the board of trustees of certain school

districts to create a nonvoting student trustee position on the

board.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter C, Chapter 11, Education Code, is

amended by adding Section 11.0512 to read as follows:

Sec. 11.0512. STUDENT TRUSTEE. (a) This section applies

only to a school district to which Section 11.0511 does not apply.

(b) In addition to the number of trustees of a school

district as provided by Section 11.051, the board of trustees of a

school district may appoint a student trustee in the manner and for

a term prescribed by the board.

(c) A student trustee is not a member of the board of

trustees of the school district for which the student is appointed.

A student trustee has the same powers and duties as a member of the

board of trustees, including the right to attend and participate in

open meetings of the board, except that the student trustee:

(1) may not vote on any matter before the board or make

or second any motion before the board; and

(2) is not counted in determining whether a quorum

exists for a meeting of the board or in determining the outcome of

any vote of the board.

SECTION 2. This Act takes effect September 1, 2025.
