Bill text, introduced version (I)

The population test, a county over 1.5 million with more than 75 percent of residents in one city, narrows a Local Government Code section to very few places, likely one county. The caption says only 'certain school campuses' and never names the bracket.

Summary

Low income housing on annexed land triggers it, only in a county over 1.5 million.

When a low income housing development is built or rehabilitated on annexed land in certain large counties, the city must ask each affected school district for a study of the campus upgrades needed to handle the new students, then pay for those upgrades. It touches cities, school districts, and housing developments on annexed land, but only in a county of more than 1.5 million people where more than 75 percent of residents live in one city. On the ground, that city carries the capital cost of school expansions tied to these projects, on a timeline it agrees on with the district, starting September 1, 2025.

A BILL TO BE ENTITLED

AN ACT

relating to the improvement of certain school campuses based on the

construction or rehabilitation of certain low income housing

developments in the attendance zone of those campuses.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Chapter 380, Local Government Code, is amended

by adding Section 380.005 to read as follows:

Sec. 380.005. REQUIRED MUNICIPAL FUNDING OF CERTAIN CAPITAL

IMPROVEMENTS. (a) In this section, "development" has the meaning

assigned by Section 2306.6702, Government Code.

(b) This section applies only to land that is:

(1) located in a county with a population of more than

1.5 million and in which more than 75 percent of the population

lives in a single municipality; and

(2) annexed by a municipality under Chapter 43.

(c) A municipality in which a development is being

constructed or rehabilitated on land to which this section applies

shall request from each independent school district with a campus

whose attendance zone includes the development an impact study that

evaluates the capital improvements necessary for the campus to

reasonably accommodate the estimated increase in the number of

students that will result from the development.

(d) Notwithstanding any other law and based on the results

of the impact study a municipality requests under Subsection (c),

the municipality shall fund the capital improvements identified as

necessary in that study. The capital improvements must be

completed in the manner and based on the timeline agreed on by the

municipality and independent school district.

SECTION 2. Section 380.005, Local Government Code, as added

by this Act, applies to the construction or rehabilitation of a

development that is in progress on or after the effective date of

this Act.

SECTION 3. This Act takes effect September 1, 2025.
