Summary

Election Code offenses don’t apply, if the agency authorized the conduct.

The bill says that Election Code offenses do not apply to a Texas peace officer or prosecutor who is investigating or prosecuting an election-law violation. The shield covers only conduct that the officer's law enforcement agency authorized and that furthers an official investigation. In practice, officers working election cases, such as undercover work, could do things that would otherwise be Election Code offenses, starting September 1, 2025.
