Summary

Already a third-degree felony. Now the penalty scales with the money gained.

This bill raises the penalties for the existing state offense of misusing official information, which is already a third-degree felony. It touches public servants and anyone else covered by that offense, and it ties the penalty level to how much money the person gained. A net gain under $150,000 stays a third-degree felony, a gain of $150,000 to under $300,000 becomes a second-degree felony, and a gain of $300,000 or more becomes a first-degree felony, starting September 1, 2025.
