Summary

Teachers and librarians lose it. For possession of abuse material, only judicial or law enforcement purposes remain.

The bill strips the "educational" purpose defense from two Penal Code offenses: distributing harmful material to minors and sexual performance by a child. For possession of child sexual abuse material, it narrows the defenses to only a judicial or law enforcement purpose, dropping the medical, psychological, legislative and close-in-age defenses that used to carry over. Teachers, librarians, schools and others who relied on an educational justification can no longer raise it in court for conduct on or after September 1, 2025.
