Summary

On no-evidence motions, judges can’t stop at what’s attached to the response.

The bill adds one rule to Texas civil law: when a judge rules on a no-evidence motion for summary judgment, the judge must consider all evidence on the record or otherwise before the court. It touches parties in civil lawsuits, especially the side facing a motion that claims they have no evidence, and the trial judges who decide those motions. On the ground, judges could no longer limit themselves to evidence attached to the response, and the rule applies to motions already pending on September 1, 2025, as well as new ones.

The bill changes how easily a civil case can be thrown out before trial, which makes it harder to win early dismissal of lawsuits.
