A physician’s reasonable medical judgment decides.
The bill adds an exception to the Texas abortion ban for cases where a physician, using reasonable medical judgment, decides an abortion is necessary because of a lethal fetal anomaly or diagnosis. It touches physicians and pregnant patients facing a lethal fetal diagnosis. On the ground, doctors could perform abortions in those cases without violating the ban starting September 1, 2025.
