Pharmacists who follow the order get a shield from lawsuits, prosecution and license discipline.
The bill orders the state health commissioner to issue a statewide order that lets any licensed pharmacist dispense an FDA-approved emergency contraceptive without a doctor's prescription. It touches pharmacists, patients seeking emergency contraception, the state health department and the Texas State Board of Pharmacy. Pharmacists who follow the order's standard procedures get protection from lawsuits, prosecution and license discipline unless they act with gross negligence or willful misconduct, and each one must file a yearly count of what they dispensed.
