relating to the consideration for approval by the executive
director of the Texas Commission on Environmental Quality of an
application for an authorization to use a certain standard permit
for a concrete batch plant.
Applies after a public hearing on the standard air permit.
The bill changes how the head of the Texas Commission on Environmental Quality decides whether a concrete batch plant can use the standard air permit after a public hearing. Besides checking the permit rules and public comments, the director must also weigh harm to local property values and how close the plant sits to homes, schools, churches, parks and other community assets. If the director denies an application, the director must explain why and say what changes would let the plant qualify, for applications filed on or after September 1, 2025.
