relating to the personal liability of an elected state officer of a
state governmental entity for a claim brought against the entity
under the whistleblower protection laws.
Direct the firing, pay the judgment yourself. No immunity, and pending cases count.
The bill makes an elected state officer personally pay any settlement or final judgment a public employee wins in a whistleblower suit when that officer directed the firing, suspension or other punishment of the employee for reporting wrongdoing. It touches statewide elected officials who run state agencies and the state employees who report violations of law. The officer cannot claim immunity or have the state cover the bill, and the rule reaches cases already pending as well as new ones starting September 1, 2025.
