Summary

Arbitration in Texas, under Texas law, and the policy too.

The bill says any surplus lines insurance policy that includes an arbitration clause must require the arbitration to happen in Texas under Texas law, and the policy itself must be read under Texas law. It touches surplus lines insurers, which cover risks standard insurers will not take, and the Texas people and businesses who buy those policies. Starting with policies issued or renewed on or after January 1, 2026, a Texas policyholder in a dispute cannot be sent to arbitrate out of state or under another state's or country's law.
