Summary

No letter, e-mail or oral demand unless the sign breaks a covenant. Win, get attorney’s fees.

The bill bars a property owners' association from sending a homeowner any letter, e-mail, or oral demand trying to restrict a political sign, unless the sign actually breaks a covenant the existing law allows. It touches homeowners who put up political signs and the HOAs that police them. A homeowner who gets an improper demand can sue to stop the practice, and the court must award attorney's fees if the homeowner wins.

A BILL TO BE ENTITLED

AN ACT

relating to the authority of a property owners' association to

regulate a property owner's display of political signs.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 259.002, Election Code, is amended by

adding Subsection (f) to read as follows:

(f) Unless a sign described by Subsection (b) is displayed

in violation of a restrictive covenant permitted by this section, a

property owners' association may not issue to the property owner

displaying the sign any communication, including a letter, e-mail,

or oral demand, purporting to restrict the sign's display. A

property owner who receives a communication from a property owners'

association issued in violation of this subsection may bring an

action for injunctive relief under this subsection to enjoin the

association from engaging in the practice. The court shall award

reasonable attorney's fees to a property owner who prevails in an

action under this subsection.

SECTION 2. This Act takes effect September 1, 2025.
