Bill text, introduced version (I)

The caption limits the bill to abuse committed against a child. But the definition lists adult offenses like sexual assault and aggravated sexual assault with no child-victim limit, so gag clauses about adult cases appear to be voided too.

Summary

Caption: abuse against a child. Definition: sexual assault, no child-victim limit. Old contracts count too.

The bill voids any part of a nondisclosure or confidentiality agreement that bars a person from telling a third party about an act of sexual abuse or the facts around it. It reaches employment agreements, settlement agreements and any other contract, including ones signed before the law takes effect, though the parties can still keep the settlement amount and terms confidential. Starting September 1, 2025, a victim or witness who speaks about covered abuse cannot be held to a gag clause in court.
