Summary
Compliance agreements cover regional services taking over out-of-compliance systems.
The bill lets the state environmental commission sign compliance agreements that pause enforcement against a regional water, sewer, wastewater, or solid waste service while it absorbs a smaller system that is out of compliance. It widens the list of systems that can be absorbed under this deal beyond city and county systems to include regional service areas and unincorporated service areas, and it makes clear that the absorbing regional operator can be a retail public utility. On the ground, more takeovers of troubled local systems can go forward without the new operator being penalized for the old system's existing violations, as long as the agreement includes steps to fix them.
