THE TEXT

…“order does not impose standards more stringent than the standards”…

Bill text, introduced version (I)

The caption only promises construction standards for RV parks. The body also puts a ceiling on local rules, so no city or county can require more than the state standard on health, electrical, propane or fire safety, and the caption never mentions that limit.

Summary

Caption: construction standards. Bill: no city or county can go stricter on fire, propane or electrical.

The bill makes privately owned RV parks and campgrounds follow a national fire-safety standard for RV parks, the 2021 edition of NFPA 1194. It also bars state agencies, cities and counties from setting stricter local rules on sanitation, electrical systems, propane storage or fire protection for those parks. Parks already operating get until September 1, 2026 to comply, and local rules tougher than the state standard stop working.

A BILL TO BE ENTITLED

AN ACT

relating to construction standards for certain recreational

vehicle parks and campgrounds.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subtitle A, Title 9, Health and Safety Code, is

amended by adding Chapter 764 to read as follows:

CHAPTER 764. RECREATIONAL VEHICLE PARK AND CAMPGROUND CONSTRUCTION

STANDARDS

Sec. 764.001. DEFINITION. In this chapter, "governmental

entity" means this state or a state agency or political subdivision

of this state.

Sec. 764.002. APPLICABILITY. This chapter applies only to

a recreational vehicle park or campground consisting of a privately

owned parcel or tract of land under the control of a person or

entity, other than a governmental entity, on which sites for

recreational vehicles, recreational park trailers, or other

camping units are offered primarily for transient guest use by

members of the public or an organization for overnight stays.

Sec. 764.003. MINIMUM STANDARDS. A recreational vehicle

park or campground to which this chapter applies must comply with

the National Fire Protection Association 1194, Standard for

Recreational Vehicle Parks and Campgrounds, 2021 Edition, other

than Section 1.1.1.

Sec. 764.004. EFFECT OF OTHER LAW. A governmental entity

may adopt a policy, rule, ordinance, or order to regulate

environmental health and sanitation, electrical distribution

system safety, liquefied petroleum gas storage and dispensing

safety, or fire protection only if the policy, rule, ordinance, or

order does not impose standards more stringent than the standards

imposed under Section 764.003.

SECTION 2. Notwithstanding Chapter 764, Health and Safety

Code, as added by this Act, a recreational vehicle park or

campground to which that chapter applies operating on the effective

date of this Act is not required to comply with that chapter before

September 1, 2026.

SECTION 3. This Act takes effect September 1, 2025.
