Summary

Mostly up to $25,000 a day per violation.

The bill raises the maximum administrative, civil and criminal fines for breaking Railroad Commission oil, gas and injection-well rules, mostly to $25,000 a day per violation. It touches operators, permit holders and pipeline companies regulated by the Railroad Commission, and it requires the commission to adopt penalty guidelines with public input for all violations, not just pipeline safety. On the ground, violators face fines up to two and a half to five times higher, and the commission must weigh factors like economic benefit gained and deterrence when setting penalties.

The fiscal implications of the bill cannot be determined due to the number of violations that would occur under the increased penalty structure, compliance behavior, enforcement discretion, and penalty adjustments based on the guidelines of the bill being unknown. The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.
