The September 1, 2025 date is not the real start, because the weight allowance is switched on only by future federal action. If that action never comes, the bill never bites.

Summary

Tank weight allowance up to 82,000 pounds total, if federal action ever comes. Otherwise nothing.

The bill lets trucks and truck combinations that run mainly on hydrogen go over Texas weight limits by the extra weight of a hydrogen tank and fueling system compared with a diesel one, up to a hard cap of 82,000 pounds total. It touches hydrogen truck operators and anyone hauling freight on Texas roads with those vehicles. It only takes effect if Congress or a federal agency first allows heavier hydrogen vehicles on federal highways, and if that never happens, the bill does nothing.

A BILL TO BE ENTITLED

AN ACT

relating to weight limitations for hydrogen-fueled motor vehicles.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 621.101, Transportation Code, is amended

by adding Subsection (b-2) to read as follows:

(b-2) Notwithstanding any other provision of this section,

a vehicle or combination of vehicles that is powered by an engine

fueled primarily by hydrogen may exceed any weight limitation under

this section by an amount that is equal to the difference between

the weight of the vehicle attributable to the hydrogen tank and

fueling system carried by that vehicle and the weight of a

comparable diesel tank and fueling system, provided that the

maximum gross weight of the vehicle or combination of vehicles may

not exceed 82,000 pounds.

SECTION 2. (a) Except as otherwise provided by this

section, this Act takes effect September 1, 2025.

(b) This Act takes effect only if the United States Congress

enacts legislation or a federal agency adopts a regulation that

becomes law authorizing a vehicle that is powered by an engine

fueled primarily by hydrogen to be operated on a federal interstate

or highway at a weight that exceeds a weight limitation established

by federal law. If the United States Congress or a federal agency

does not enact legislation or adopt a regulation that becomes law

described by this subsection, this Act has no effect.
