Summary

Counselors can’t give affirming therapy to a child. Out-of-state referrals are barred too.

The bill makes it a state jail felony for a doctor or health care provider to perform gender transition surgeries or give puberty blockers or cross-sex hormones to a child, which current law already bans. It also bars non-physician mental health professionals, such as counselors, from giving a child therapy that affirms a gender that does not match the child's biological sex, and it bars doctors, providers and counselors from referring a child to an out-of-state practitioner for care that would be banned in Texas. Starting September 1, 2025, breaking any of these rules becomes a state jail felony offense instead of only a licensing or civil matter.
