Summary

Added to the list of care facilities that check workers.

The bill adds state-licensed private mental hospitals and mental health facilities to the list of care facilities that must run criminal history checks on workers. It also doubles, from five years to ten, the waiting period after certain convictions, such as assault, burglary, felony theft and fraud, before a person can work in direct contact with patients at any covered facility or for an individual employer. Licensed mental hospitals must also write down their drug-testing and background-check policies and hand them to patients, their families and anyone who asks, starting September 1, 2025.
