Summary
Three-year licenses, a fee, inspections every two years.
The bill moves the existing state law on group homes into a new chapter and turns it into a full state license program run by the Health and Human Services Commission, with a license fee, three-year licenses, inspections at least every two years, and power to deny, suspend, revoke or close. It touches anyone running a home that lodges three or more unrelated residents and helps with things like meals, laundry, transportation, money or medication, though nursing homes, assisted living, hotels, retirement communities, child-care facilities, shelters and college dorms are exempt. Group homes would need a state license to operate, existing ones could get a six-month provisional license, and an owner who hires or keeps a worker with certain listed convictions or any Class A misdemeanor or felony commits a Class A misdemeanor offense.

THE TEXT
…“license fee in an amount the executive commissioner sets by rule”
Bill text, introduced version (I)
The bill creates a new license fee set by agency rule with no cap. The caption openly says it is authorizing a fee, so this is disclosed and not a trick.

(b) The denial, suspension, or revocation of a license by the commission and the appeal from that action are governed by the procedures for a contested case hearing under Chapter 2001, Government Code. (c) The status of a person as an applicant for a license or as a license holder is preserved until final disposition of the contested matter, except as the court with jurisdiction of a judicial review of the matter may order in the public interest for the welfare and safety of the group home facility residents. Sec. 260E.010. EMERGENCY SUSPENSION OR CLOSING ORDER. (b) The commission shall provide for the relocation of residents of a group home facility that is closed. The executive commissioner shall adopt rules governing relocation procedures under this section. Sec. 260E.011. RULES.
