relating to public hearing requirements for issuing a license for or expanding certain residential child-care facilities.

Caption from analyzed text · version I.

Summary

County cutoff rises from under 300,000 to under 500,000. Applicants pay.

The bill widens an existing rule that makes applicants hold a public hearing and publish newspaper notice, at their own cost, before the state licenses or expands certain residential child-care facilities. It raises the county population cutoff from under 300,000 to under 500,000, so it touches operators of general residential operations, cottage home operations, and continuum-of-care operations in mid-sized counties. Starting September 1, 2025, facilities in counties between 300,000 and 500,000 people must also go through the hearing and notice steps before getting a license or adding capacity.

A BILL TO BE ENTITLED

AN ACT

relating to public hearing requirements for issuing a license for

or expanding certain residential child-care facilities.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 42.0461(a), Human Resources Code, is

amended to read as follows:

(a) Before the department may issue a license or certificate

for the operation or the expansion of the capacity of a general

residential operation, a cottage home operation, or a

continuum-of-care residential operation that is located in a county

the license, certificate, or expansion shall, at the applicant's

expense:

(1) conduct a public hearing on the application in

accordance with department rules after notifying the department of

the date, time, and location of the hearing; and

(2) publish notice of the application in a newspaper

of general circulation in the community in which the child-care

services are proposed to be provided.

SECTION 2. This Act takes effect September 1, 2025.
