Summary

Developers skip writing the special needs preference into the agreement.

The bill bars the Texas Department of Housing and Community Affairs from making developers who get its financial help write a special needs population tenant admission preference into the land use restriction agreement for their development. It touches housing developers that receive department-administered money, including money from department bonds, and the department itself. On the ground, the department can no longer demand that recorded preference unless federal law requires it, starting September 1, 2025.
