relating to the effect of payments made after the deadline for presuit notice in actions against an insurer related to certain claims for property damage.

Caption from analyzed text · version I.

Summary

Paying after the presuit deadline no longer shrinks what’s owed.

The bill says that when an insurer pays a property damage claim after the deadline for presuit notice, that late payment does not cut off the policyholder's right to recover interest, penalties, attorney's fees, or other damages. It touches insurers and policyholders who sue over property damage claims under the Insurance Code chapter that governs those lawsuits. On the ground, an insurer can no longer pay late and then use that payment to shrink what it owes in interest, penalties, or fees, for lawsuits filed on or after September 1, 2025.
