Summary

Withholding on a past ruling? Name the ruling.

The bill sets new 10-business-day deadlines for Texas governmental bodies to tell a records requestor in writing when they have no responsive records, or when they are withholding records based on a past ruling, and to name that ruling. It covers every governmental body and public information officer that handles open records requests, plus the people who file those requests. If a body misses these duties, the requestor can complain to the attorney general, who can order open records training, bar the body from charging fees for that request, and require it to seek a ruling within five business days and release the records unless there is a compelling reason to withhold them.
