Summary

Two years after the claim is paid to get it back.

The bill requires property insurance policies to let a policyholder recover depreciation the insurer held back from a covered claim for up to two years after the insurer pays the claim. It touches insurers writing property coverage and the homeowners and businesses they insure. Policies issued or renewed on or after January 1, 2026 must give insureds that two-year window, and the held-back money cannot be counted as defense costs or taken out of defense coverage limits.
