Covers providers who deceive a patient during actual or claimed treatment.
The bill adds a new situation to the Texas sexual assault law in which sex counts as without consent: when a mental health or health care provider, or someone pretending to be one, gets a patient to submit by creating or confirming a false impression of law or fact during actual or claimed treatment. It touches licensed doctors, nurses, chiropractors, physical therapists, physician assistants, mental health providers, and people who pose as health care providers, along with the patients they treat. Starting September 1, 2025, prosecutors can bring a sexual assault case based on that kind of deception in a treatment setting, for conduct on or after that date.
