Summary

Trained family help with private duty nursing at home.

The bill sets up a way for parents, guardians, or family members of children in the STAR Kids Medicaid program to get trained and certified as "complex care aides" and help deliver the private duty nursing care their child already gets at home. To do the work, the family member must finish state-approved training, be hired by the home health agency that already sends the child's registered nurse, and work only under that nurse's delegation and supervision, with tracheostomy care excluded. The state must flag eligible families in its screenings, tell parents about the option, and pay agencies at least 90 percent of the licensed vocational nurse rate for this aide care, capped at 40 hours a week, with the option available by September 1, 2026.

The fiscal implications of the bill cannot be determined. According to the Health and Human Services Commission (HHSC), the agency would not be able to implement the provisions of the bill because federal law requires private duty nursing services to be provided by only a registered nurse or a licensed practical nurse.

of a recipient participating in the program;

(B) certified under the program to assist in

providing certain private duty nursing services; and

(C) employed by the home and community support

services agency providing services to the recipient.

(3) "Private duty nursing services" means nursing

Sec. 531.802. CERTIFIED COMPLEX CARE AIDE. The commission

shall develop policies to enable a parent, legal guardian, or

The commission shall:

(1) add criteria to any screening tool or other
