Summary

Late payers land on a state delinquent list until they pay in full.

The bill requires Texas distillers to give wholesalers a dated invoice and requires wholesalers to pay for liquor within 30 days of receiving it. A distiller can report a late-paying wholesaler to the state alcohol commission, which must keep a list of delinquent wholesalers and take them off once they pay in full. A delinquent wholesaler cannot renew, transfer, voluntarily cancel or suspend its permit, and cannot hold any other alcohol permit until the debt is cleared.

AN ACT

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter B, Chapter 102, Alcoholic Beverage

rectifier's permit holder. The invoice must include the date of

purchase.

(b) The holder of a wholesaler's permit shall pay for liquor

purchased from the holder of a distiller's and rectifier's permit on

or before the 30th day after the date the wholesaler receives the

invoice.

(c) If the holder of a wholesaler's permit becomes

delinquent in the payment of an account for liquor under this

section, the holder of the distiller's and rectifier's permit may

whose permit is canceled by the commission or whose permit has

expired is not eligible to hold any other permit or license under

this code until the person has cured any delinquency of the person

under this section.

(f) The commission shall adopt rules to implement this

section.
