Summary

Sexual performance by a child becomes a first-degree felony. Scientific, educational and spousal defenses are gone.

The bill raises the penalties for selling, showing, or giving harmful material to a minor, making every such offense a second-degree felony, and makes every offense of sexual performance by a child a first-degree felony. It also strips away the defenses that a person had a scientific, educational, governmental, or similar reason, or was the minor's spouse, and repeals a subsection of the child sexual performance law. Anyone accused under these sections, including sellers, distributors, and people with an educational or professional justification, faces longer sentences and fewer defenses for conduct on or after September 1, 2025.
