Summary

No dropping it, no step therapy, no higher tier at renewal. Other changes need 60 days’ notice.

The bill bars health insurers, at plan renewal, from cutting back coverage of a prescription drug an enrollee was already using the prior year when the prescriber and patient decide it is the best treatment. It reaches state-regulated health plans and their enrollees, but explicitly excludes self-funded employer plans, Medicaid, CHIP, and other listed plan types. Insurers can no longer drop the drug, add prior authorization or step therapy, raise copays, or move it to a higher cost tier for those continuing patients. They must also give 60 days' notice of other drug coverage changes, and changes that favor patients can be made at any time.

THE TEXT

…“may not modify an enrollee's contracted benefit level for any”…

Bill text, introduced version (I)

The bill mandates that insurers keep covering a prescribed drug at the same benefit level for continuing enrollees, though it still lets pharmacists swap in generic or interchangeable biologic versions.
