Summary
First-degree felony to take a Texas child out of state for one.
The bill makes it a first-degree felony offense to travel from Texas to another state with a Texas child so the child can get a gender transition procedure or treatment that Texas law already bans inside the state. It reaches any person who makes that trip with the child, with an exception for procedures that existing Texas law already allows. Starting September 1, 2025, taking a child across state lines for these banned treatments becomes a serious offense in Texas.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter X, Chapter 161, Health and Safety Code, as added by Chapter 335 (S.B. 14), Acts of the 88th Legislature, Regular Session, 2023, is amended by adding Section 161.707 to read as follows: Sec. 161.707. CRIMINAL OFFENSE. (a) A person commits an offense if the person travels from this state to a location outside this state with a child who is a resident of this state to facilitate the child's ability to receive a procedure or treatment that would otherwise be prohibited by Section 161.702 if the procedure or treatment occurred in this state.
