Summary

Professional services providers can’t buy goods around the bidding rules.

The bill adds one sentence to the school purchasing law that already exempts professional services like architects, attorneys and accountants from competitive bidding. The new sentence says that exemption cannot be read to let a professional services provider buy goods or services for a school district in a way that skips the normal purchasing rules. School districts and the consultants and professionals they hire are affected, and on the ground a district can no longer route ordinary purchases through a hired professional to avoid bidding rules.

A BILL TO BE ENTITLED

AN ACT

relating to a contract for professional services rendered to a

school district.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 44.031(f), Education Code, is amended to

read as follows:

(f) This section does not apply to a contract for

professional services rendered, including services of an

professional services rendered by a financial consultant or a

technology consultant in the manner provided by Section 2254.003,

Government Code, in lieu of the methods provided by this section.

This subsection may not be construed to permit the purchase by a

professional services provider on behalf of a district of goods or

services that would otherwise be subject to the purchase procedures

required by this subchapter in a manner that violates those

procedures.

SECTION 2. This Act takes effect September 1, 2025.
