Summary

Actual or perceived gender, regardless of sex designated at birth.

This bill adds a definition of "gender" to the state law that lets a court make a finding that an offense was committed because of bias or prejudice. Gender would mean a person's actual or perceived gender-related characteristics, regardless of the sex designated at birth. That widens who counts as a target of gender bias under the existing bias-finding law for offenses committed on or after September 1, 2025.
