Summary
Usual and customary rate, not the contracted rate.
The bill changes how late-payment penalties are figured when an HMO or a preferred provider insurer pays certain doctor and provider claims late. For physicians and providers covered by Sections 843.351 and 1301.069 of the Insurance Code, the penalty is based on the usual and customary rate for the service in that area, not on a contracted rate. Insurers that pay these claims late could owe penalties calculated on a local market rate, starting with claims submitted on or after September 1, 2025.
