Summary
One prior intoxication assault or manslaughter, or two other priors.
The bill raises the penalty for intoxication assault to a second-degree felony when the person already has one prior conviction for intoxication assault or intoxication manslaughter, or two prior convictions for other drunk-operation offenses such as driving, flying or boating while intoxicated. It touches drivers and other operators with prior intoxication convictions who cause serious bodily injury, along with prosecutors and courts. The existing tougher penalties for injuring firefighters, EMS workers, peace officers or judges stay in place, and the new rule applies to offenses committed on or after September 1, 2025.
