Summary
Fees and costs go to whichever side wins a records suit.
The bill makes attorney's fees and court costs available to whichever side wins a lawsuit over access to homeowners' association records, not just the association. It also lets a homeowner who sues their property owners' association stop paying assessments while the lawsuit is pending, regardless of what the association's rules say. If the association wins, the owner must pay back everything withheld, but if the owner wins, the association cannot sue to collect the withheld assessments.
