relating to elimination of the motor vehicle emissions inspection and maintenance program.

Caption from analyzed text · version I.

Summary

The program ends only after specified federal law, court or constitutional changes.

The bill would bar the Texas Commission on Environmental Quality and the Department of Public Safety from running or enforcing vehicle emissions inspections. That ban would start only on the 30th day after Congress repeals or changes the federal Clean Air Act so the program is no longer required, the United States Supreme Court recognizes a state power to prohibit these programs, or the United States Constitution is amended to grant that power. If none of those events happens, the ban has no effect and the emissions inspection program continues as before.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter G, Chapter 382, Health and Safety
