THE TEXT

“The commission shall submit the initial report required by Subsection (c) not later than December 31, 2026.”

Bill text, introduced version (I)

The bill's only duty is to analyze and report on unused water rights, and any actual cancellation is left to later action. The caption honestly says it is a study, which keeps confidence moderate.

Summary

Rights unused for 10 years go on a list. Cancelling them waits for later action.

The bill requires the Texas Commission on Environmental Quality to review, at least once every five years, water rights where some or all of the permitted water has gone unused for the past 10 years. The commission must send a written report to the water development board, Parks and Wildlife, and the Legislative Budget Board listing which unused rights are exempt from cancellation, which may be cancelled, how much water is involved, whether cancellation has started, and whether the water could go to the Texas Water Trust. No water right is cancelled by this bill; it only produces a list, with the first report due by December 31, 2026.
