Summary

Adults whose gender identity differs from the sex recorded at birth are shut out.

The bill limits who can adopt or foster a child in Texas to adults who identify as the same biological sex listed on their original birth certificate. It touches every adult who wants to adopt or foster, and it shuts out anyone whose gender identity differs from the sex recorded at birth. On the ground, adoption petitions and foster eligibility would turn on this new test, starting immediately with a two-thirds vote or on September 1, 2025.
