…“may be delayed until the second school year after the school year the rule is adopted”…

Bill text, introduced version (I)

The only operative language is a passive, permissive 'may be delayed' that names no decision-maker and creates no duty, penalty or deadline. Schools get no guaranteed lead time unless someone chooses to grant it.

Summary

Delayed by whom? The bill names nobody. No duty, no deadline, all optional.

The bill adds one sentence to the school accountability chapter saying that a new accountability rule from the education commissioner or the Texas Education Agency may be delayed until the second school year after it is adopted. It touches school districts, campuses and the state agency that runs A-F ratings and related accountability procedures, and it applies only to rules adopted after the bill takes effect. The delay is optional, not required, and the bill does not say who decides to use it, so whether anything changes depends on the agency choosing to wait.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 39.001, Education Code, is amended by

adding Subsection (c) to read as follows:

(c) Notwithstanding any other law, the implementation of a

rule adopted by the commissioner or the agency that affects methods

or procedures for administering provisions of this chapter may be
