Summary

Narrows exceptions, retaining procurement, burden reductions, natural disasters and legally required rules.

The bill shrinks the list of state agency rules that are exempt from the requirement in Section 2001.0045 of the Government Code, which covers rules that put new burdens or costs on regulated people. It removes the exemptions for rules tied to federal funds or federal law, water protection, health and safety, rules implementing legislation, self-directed semi-independent agencies, and six named agencies, including the Department of Family and Protective Services, the Public Utility Commission and the Texas Commission on Environmental Quality, and it adds a single exemption for rules an agency is explicitly required by law to adopt. Starting with rules proposed on or after September 1, 2025, far more agency rules must meet that section's requirements before they can be adopted.
