Summary

Only nonprofits that mainly represent local governments. Training, insurance and buy board goods come from elsewhere.

The bill bars Texas school districts from contracting with or paying public money to certain nonprofit groups for training, insurance or risk pools, buy board goods, or investment and professional services. It covers only nonprofits that mainly represent local governments and that employ someone who must register as a lobbyist. Starting September 1, 2025, districts would have to buy those services from other sources, though contracts signed before that date stay in place.

A BILL TO BE ENTITLED

AN ACT

relating to prohibiting a school district from procuring training,

insurance products and risk pool participation, good or supplies

from a buy board, and any investment or professional services from

certain nonprofit associations or organizations.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter D, Chapter 11, Education Code, is

amended by adding Section 11.187 to read as follows:

Sec. 11.187. PROHIBITION AGAINST PROCURING TRAINING,

PRODUCTS, GOODS, CONTRACTS, AND SERVICES FROM CERTAIN ENTITIES. A

school district may not contract with or distribute public funds to

a nonprofit association or organization that primarily represents

political subdivisions of the state and that employs an individual

required to register as a lobbyist under Chapter 305, Government

Code, for:

(1) any training or instruction;

(2) an insurance product or participation in a risk

pool;

(3) goods or supplies from a buy board; or

(4) any investment or professional services.

SECTION 2. Section 11.187, Education Code, as added by this

Act, applies only to a contract entered into on or after the

effective date of this Act. A contract entered into before the

effective date of this Act is governed by the law in effect on the

date the contract was entered into, and the former law is continued

in effect for that purpose.

SECTION 3. This Act takes effect September 1, 2025.
