Summary

Only a written threat of suit or written demand counts.

The bill narrows when a government body can withhold records by claiming litigation is 'reasonably anticipated,' allowing that claim only if someone has threatened suit in writing or made a written demand for compensation. It also lets a person who is the subject of certain closed law enforcement records, or that person's attorney, get those records, and if the person has died, lets a spouse, child, parent, estate administrator or their attorneys get them. The change applies to public information requests received on or after September 1, 2025, so agencies will have fewer grounds to deny these requests.
